MEMBER AGREEMENT

1. Purchase Agreement
I understand and agree that Bonvoyage Elite (hereafter BVElite) Lifetime Membership (hereafter “Membership”) is sold "AS IS" without warranty or guarantee of any kind. I understand that I will gain immediate access to travel information and consulting services. Since the benefit of the Membership is immediate upon purchase I understand and agree purchase of the BVElite Membership is FINAL and NO REFUNDS will be issued after the initial 3 day cancellation period (10 day cancellation period for residents of Canada only). See item #9 below.
By accepting this statement, I am agreeing not to reverse or chargeback this Membership once purchased.

 

2. Term
The Bonvoyage Elite Lifetime Membership provides benefits for life, provided the annual renewal fees are paid within the specified timeframe. If you fail to annually renew your Membership, or if it is canceled for any reason, you understand that you will permanently lose all rights and privileges as member. The annual renewal fee is $10. The fee is subject to change upon advance notice.

If you allow your membership to expire due to nonpayment, you will lose any and all rights your membership unless you re-activate within 14 days following the expiration. If you re-activate within the 14-day grace period, you will not be required to pay the full purchase price for the membership.

 

3. Member Benefits
BVElite Members are issued a BV number and an online Lifestyle Card, which they may print from their back office. Members use their BV number to access our Concierge services and help plan, search, and find the best possible vacation and travel deals available. Such travel related goods and services may only be accessed through our Concierge Service, either directly online or with assistance from a Concierge via Vacation Request Form, email, fax, or phone. These travel goods and services are offered without opportunity for prior inspection. Members may be required to pay shipping and handling fees and other costs incidental to the purchase of such travel good and services. The travel goods and services available through the BVElite Membership are purchased from third party vendors and not from Bonvoyage Elite.

The Membership offered by Bonvoyage Elite is not a discount buying service. The membership offers the following and is not limited to; Travel consulting and guidance on How to vacation and finding, planning for the best possible vacation that fits you; Member only access to Concierge’s list of a variety of sources to thousands of weeks of vacation condo properties around the world with no presentations, ownership fees or obligations; Since such a vast access is made available to our members, not all listings provided including hotel, airline and car rentals will necessarily be lowest. Similar or lower prices for some travel and travel related purchases may be available from other sources including the Internet and other for pay membership or corporate clubs.

 

4. No Liability
BVElite shall not be liable for injury, loss, or damage to persons or property for any reason while at any resort, during any cruise, or while in transit. BVElite, its agents and IBOs act only as marketers for the Private Club Membership and do not assume any responsibility for any loss, delay, accident, injury or damage to persons, property or any liability whatsoever arising from or in conjunction with travel related goods and services provided. BVElite, its agents and IBOs are not responsible for any act of God, causing destinations to become unavailable or hazardous. Bonvoyage Elite makes no representation regarding the products and services of third party vendors and in no event shall Bonvoyage Elite, its agents and IBOs be liable for any act or omission of a third party vendor.

 

5. Change of Address, Telephone, Email-Address

To ensure timely delivery of products and services, it is critically important that BVElite files are current. It is each Member’s responsibility to ensure the address, telephone, and email address is current in their profile.

 

6. One Membership per Person
BVElite Membership provides access to the complete product for the life of the Member. There is no reason to own more than one membership per person.

 

7. Business Entities
A corporation, partnership or trust (collectively referred to in this section as a "Business Entity") may apply to be a BVElite Member. Eligible Business Entities are comprised of one person or multiple people who reside in the same household. Members of the Business entity are jointly and severally liable for any indebtedness or other obligation to BVElite.

 

8. Change of Enroller
To protect the integrity of and safeguard the hard work of all IBOs, BVElite does not allow changes in enrollers after a BVElite Membership has been sold. It is the responsibility of the Member to ensure s/he registers and pays under the correct Enroller.

BVElite executive management reserves the right to make exceptions to this policy at its sole discretion as needed to preserve the integrity of the commission Program

 

9. Membership is non-transferable
BVElite Membership is unique to the Member and is not transferable.

 

10. Refund Procedure and Chargeback Protection
There are no refunds allowed beyond the initial 3 day cancellation period. Residents of Canada have a 10 day cancellation period.
If a Member requests a permitted refund their Membership will be terminated and the commission of the direct enroller will be reduced accordingly.
Refund requests must be made in writing by submitting a support ticket no later than midnight PST on the third day after payment has been made. Valid refunds will be paid via a method determined by BVElite.
If a Member reverses or charges back their purchase of the BVElite Membership after the initial cancellation period, their Membership will be terminated and the commission of the direct enroller will be reduced accordingly.

11. Changes to Methods of Payment for Membership
Acceptable methods for purchase of Membership are clearly presented in the back office of each applicant. BVElite reserves the right to change, add, or eliminate methods of purchase at any time.

 

12. Changes to the Member Agreement
Because federal, state, and local laws, as well as the business environment periodically change, BVElite reserves the right to amend any and all terms of the Member Agreement including but not limited to the price and renewal provisions of BVElite Products in its sole and absolute discretion.
